BBB Helped solving the Diamond Parking Ticket

 

June 1st, 2010, I received an email from BBB with following content:

The Better Business Bureau (BBB) has received a response from the business regarding your complaint. Please review the response and advise us, in writing, of your position in this matter. You should attach supporting documents.
If you are not satisfied with the business response, we may be able to offer further assistance, if both parties agree, through a dispute resolution process which is legally binding. Alternatively, please provide us with another offer we can present to the company in an effort to resolve this dispute.
Note that if we do not receive further correspondence from you by June 15, 2010, we will trust that you are satisfied with the company's response and our office will close the file.

I checked the url, and see the following response from Diamond Parking:

We have voided both tickets because we have no other tickets on file for either vehicle. We will not cancel any future tickets for either vehicle.

This is good, Diamond Parking voided both tickets!  I then went to the website to indicate I’m satisfied with the resolution.  I got another email June 2nd, 2010 from BBB:

Based on the information that we have received from both parties, this complaint appears to be resolved.
This case is now closed as Resolved.
The Better Business Bureau (BBB) develops and maintains Reliability Reports on companies across Canada and the United States. This information is available to the public and is frequently used by potential customers. This resolved complaint will now become reflected in the report that we give to consumers.

BBB started to process the case

Just got an email from BBB about the diamond parking ltd. complaint.  Copy as following:

Talking to Collection Agency on May 18th, 2010

 

I received phone call from Wiggings Adjustments Ltd. on May 17th for money collection.  I wasn’t home and they left a number for me to call back.  I called back on May 18th, Pers Brown from Wiggings Adjustments Ltd. heard there is a dispute, and gave Diamond Parking email address to me, saying we should finish dispute process first, and they will hold the “interest” until dispute is finished.

So I wrote the email to Mike Poirier of Diamond Parking (I saw his email in public forum before as well, so I’m not going to write it here) this morning, attached my April 12th letter to Diamond Parking, asking them to respond to the letter.

I’ll keep post about the process.

Get a notice from debt collector

 

On May 12th, 2010, I get two letters from Wiggins Adjustments Ltd.  Looks like Diamond parking already sold the “debt” to a collector company.  The amount for each “ticket” went from $105 to $214.  How interesting.

The letter looks like following:

I wrote a letter to this company, content like following:

Wiggings Adjustments Ltd.

Collection Department

To whom it may concern,

I received 2 letters with account # xxxxx and xxxx, each with $213.68 balance.

I’ve dealing the issue with Diamond Parking. And I’ve filed complaint with Better Business Bureaus. I’ve attached the letter after this letter so you understand what the situation is.

From my point of view, you have no right to collect any money for Diamond Parking because I don’t owe them, and thus don’t owe you. If you make any move to damage my credit score, I’ll have no choice but to sue you and Diamond Parking together.

So please remove these 2 accounts from your database and pass the case back to me and Diamond Parking.

One more thing to note here, the collecting money is doubled in your letter (from $104.69 to $213.68), I think you got cheated by Diamond Parking.

I’m going to fight Diamond Parking Ticket

 

April 7th, 2010, I received 2 letters from Diamond Parking, each is a $104.69 parking ticket, for both of my car and my wife’s car.   I was first confused and then outraged after thinking of it over.

On Feb 24th, 2010, My wife and my daughter drive to Estea Beverage Club, No. 8400 Alexandra Rd Unit 180, Richmond (BC, Canada) ) at around 6:00pm.  I was a bit busy at work and went half an hour later at about 6:30pm.  I remember the TV in the restaurant still plays Russian Canadian Hockey Olympic quarter final game at the time (The game ended around 6:50pm as I researched today).  We both parked at the proper place inside the parking lot.  When my family finished dining and drive back home at around 7:30pm, there is no parking ticket displayed on our cars.

The lot is managed by Diamond Parking Ltd as shown below, which we can park for 3 hours if going to the business inside the Olympia Centre.

So the first thing I try to do after receive the ticket is trying to find my receipt.  Unfortunately, I paid by cash that day and didn’t keep a receipt.  Who keeps restaurant receipts for one month and half anyway?

I called Diamond Parking on Thursday, the lady on the phone said I’ve to pay $57 per ticket if no receipt can be found. 

I cannot agree with the ticket issuer’s practice with following reasons:

1. The ticket issuer can’t just give ticket to the cars that simply parked there without proofing they are not in the parking lot related businesses. The timing of 1st ticket is 19:19, and 2nd ticket is 19:21.  I can imaging the ticket issuer simply trying to give ticket to every cars parked in the parking lot.

2. If they give out ticket, they should put it on my car so that I can argue it immediately or the 2nd day. I don’t understand why the ticket is not on the car.

3. There are some internet forum posts blaming different kind of issues that some ticket issuers from Diamond Parking:

What am I going to do is the following:

  1. I’m not going to pay the parking ticket since I did nothing wrong.
  2. I’ll write to them and ask them to remove the tickets, since I don’t want my cars be towed away if I park in their private lot again.

  4. Increase the awareness of this issue to the public.
  5. If Diamond Parking asks the collection company to collect, I’ll state the same and refuse to pay.
